1. Acknowledgment of Risk
I, the undersigned, hereby acknowledge that I have voluntarily chosen to participate in fitness classes and activities offered by Fight o Fly Digital Kickboxing. I understand that the activities involved in these classes may include but are not limited to aerobic exercise, strength training, flexibility exercises, and other physical activities.
I acknowledge that participation in these activities involves inherent risks, including but not limited to muscle soreness, injury, heart attack, or other physical ailments. I understand that while precautions are taken to ensure my safety, these risks cannot be eliminated entirely.
2. Medical Clearance
I certify that I am in good health and have no medical conditions that would prevent my participation in the fitness activities. I have consulted with a physician regarding my participation if necessary. I agree to inform the instructor of any changes in my health status that might affect my ability to participate safely.
3. Assumption of Risk
I voluntarily assume all risks associated with my participation in fitness activities. I accept full responsibility for any injury or damage that may result from my participation, whether caused by the negligence of the instructor, other participants, or otherwise.
4. Release of Liability
In consideration of being allowed to participate in fitness activities, I hereby release, waive, and discharge Fight o Fly Digital Kickboxing, its owners, instructors, employees, and agents from any and all liability for any injury, illness, or damage that may result from my participation, including but not limited to personal injury, property damage, or death.
5. Indemnification
I agree to indemnify and hold harmless Fight o Fly Digital Kickboxing, its owners, instructors, employees, and agents from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees, arising out of my participation in fitness activities.
6. Photography and Video Release
I consent to the use of photographs and videos taken during fitness classes for promotional purposes, including social media, website content, and marketing materials. I understand that my likeness may be used without compensation.
7. Governing Law
This waiver and release of liability shall be governed by and construed in accordance with the laws of New York, USA.
8. Acknowledgment and Understanding
I have read this waiver and release of liability and fully understand its terms. I acknowledge that I am signing this agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
